VI- EXTRADITION REQUESTS FROM FOREIGN COUNTRIES :

The procedure upon the receipt of red bulletin or diffusion message from foreign countries:
Red bulletin or diffusion message for the offenders who are reported to be in our country are sent to our Ministry by Ministry of Interior as a central authority. If our Ministry is of the opinion that the offences mentioned in red bulletin or diffusion message are extraditable and there are substantial evidence to prove that the crime has been committed, by writing to Ministry of Interior it is requested to transfer him to judicial authorities if he is arrested in Turkey.
 If he is arrested he is transferred to competent Public prosecution office. Public prosecutor may transfer him to competent criminal court of peace for temporal arrest or detention. By reviewing the offence and evidence mentioned in red bulletin or diffusion message, Criminal court of peace may rule on taking him into custody or releasing him.

Although the offence ascribed to the person who is wanted is extraditable, if the competent public prosecutor or Court think that the information in red bulletin or diffusion message is not sufficient, they can request additional information or documents from our Ministry. Our Ministry gets into contact with the relevant authorities and request additional information and document. It is up to judicial authorities  to keep the person under arrest or judicial control until the mentioned information or documents are received.

Temporal Arrest/Getting people under judicial control:
Based on the information in diffusion or red bulletin, wanted person may be arrested temporary. By considering nature and facts of the offence and wanted persons situation, the court may rule on judicial control rather than imprisonment.

The period for temporal arrest is regulated in Article 16 of European Convention on Extradition.  According to this convention, temporal arrest is minimum 18 days and maximum 40 days.

As regards to extradition requests coming from states that are not party to the Convention, the period of temporal arrest is regulated by bilateral agreements between our country and the others.
